All Torres Legal products and services (“Torres”) are the property of INVERTOR, S.A. de C.V., hereinafter INVERTOR, and are provided solely and exclusively by said company. This document includes the terms and conditions (“Terms”) of use of the website, applications and all services and products (“Services”) of Torres.
It will also be necessary to read our Privacy Policy and the Cookies Policy, where we detail our information handling practices. Please read all of our policies carefully and contact us if you have any questions because, by using our Services, you agree to be bound by all of Torres’s Terms, which govern our relationship with you. In addition, once you enter the site, you agree that Torres will use the information you share in accordance with our Privacy Policy.
- Site Description and Use
Torres is a law firm specialized in law, finance and business. Through our electronic platforms, we seek to inform potential clients of our services, our team and the vision of our firm. In addition, we have a special section where users can purchase contract templates prepared by Torres’ legal team at an affordable price.
The Services offered by Torres include, but are not limited to, any content or services available or offered through the Site, in addition to any offerings of materials displayed, transmitted or developed within the Site or through the Services. Content (“Content”) includes, but is not limited to, text, user comments, messages, information, data, graphics, news, articles, photographs, videos, sounds, images, illustrations, downloadable documents and computer programs.
- Site Usage
Our Site and, in general, our Services may be used only if you are legally able to contract with Torres. Any access or use by persons legally incapable of contracting is prohibited and the responsibility of their legal representative.
At times you may not be able to access the Site or your browsing may be interrupted due to equipment failure, upgrades, maintenance or any other reason beyond Torres’ control. We reserve the right to suspend or discontinue the Site or any service and to remove any content as we deem appropriate at any time without notice. In addition, Torres may set limits on certain features and services or restrict access to all or part of the Site and its Services generally, without notice and without liability.
- User registration and license
You will need to create an account with Torres in order to use some of our Services. To do so, you will be asked for a password and a user name, as well as some registration information. You must provide accurate, complete and updated information. In the event that such information is modified, you understand that it is your right and responsibility to keep it updated and up to date, always ensuring that it is complete and accurate. Failure to do so is a violation of the Terms and may result in immediate account termination.
As a user name you may not use the name of another person or entity to which you have no rights, nor any name or trademark whose rights belong to another person or entity unless you have the proper authorization, nor a name that confuses readers into thinking that it is another person or company, nor any name that is offensive or obscene. In addition, opening accounts to robots or automated methods is prohibited.
It is your responsibility to safeguard your login information and you are solely responsible for any and all activity within your account. If you experience any breach of security or identify any unauthorized activity, you must notify us immediately. Torres is not responsible for any act or omission of the user, including any damages resulting from the above.
- Personal license
Subject to our Terms and all of our policies, you are granted a personal, limited, non-exclusive, non-transferable and fully revocable license to use our Services. This means that any Content that may be downloaded from our Site or any platform through which our services are offered is for your personal, non-commercial use only, except that you obtain Torres’s written permission to otherwise use such Content. You further agree that, by creating your user account, you will only access and make use of a single account and that you will not share such access or account information with any third party.
- Regarding services
Torres reserves the right to change its fees or charges for the Services offered on the Site (or to begin charging for any free services), provided that any fees paid prior to such changes will not be affected. Furthermore, in the event of unexpected events, Torres reserves the right to cancel, interrupt, reschedule or modify any service offered, as well as its content.
- User behavior
By having an account within our Site, if you comment on any of our forums or projects, post material or links within the Site or otherwise make any material available (or allow any third party to do so) through the Site, you will be solely responsible for what is contained in such Content – and any harm resulting therefrom. This applies to any type of Content (images, video, sounds, links, etc.). Torres does not control the Content posted by its users and, therefore, we do not guarantee its accuracy, integrity or quality. You understand that by accessing the Site you may be exposed to Content that may be offensive, indecent or objectionable.
As a user of our Services, you agree not to use the Services for any purpose that is unlawful or prohibited by these Terms. You also agree not to use the Services to:
1. Abuse, harass, threaten, impersonate or intimidate any person.
2. Post or transmit – or cause to be posted or transmitted – any content that is defamatory, obscene, pornographic, abusive, offensive, profane, or infringes any copyright or other rights of any person.
3. For any purpose (including the posting or viewing of content) prohibited by the laws in force in the place where you use the Services.
4. To post or transmit, or cause to be posted or transmitted, any communication or solicitation with the purpose or intent to obtain any password, account or private information of any user of our Site.
5. To generate or send unsolicited email or “spam” to any person or URL.
6. Post Content for which you do not own the copyright, except in the Forums, where you may do so as long as the author’s name is mentioned and a link to the source of such Content is included.
7. Use any robot, «spider», «scraper» or other automated means (excluding RSS feeds) to access the Site for any purpose without written permission. You further agree not to (i) proceed in any manner that imposes or would impose, in our sole discretion, an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any of the activities on the Site; or (iii) circumvent any of the measures we use to prevent or restrict access to the Site.
8. Advertise or solicit any user to buy or sell products or services, or use information obtained from our Services to contact, advertise, solicit or sell anything to another user without their prior consent.
9. Sell or transfer your profile.
10. Use our Services as a generic image hosting service, advertisement, publicity, etcetera.
It is clarified that the above list is not considered as exhaustive, but exemplary and it is understood that the prohibitions of use are not limited only to those described above.
We reserve the right to veto any user of our Services, in case of non-compliance with our Terms and Policies. Furthermore, Torres will not be liable for any damages resulting from visitors’ use of the Site.
- Refund Policy
In the event that a Service is purchased and paid for, Torres will make the respective reimbursement by the means of payment selected by the User at the latter’s request. Refunds will be made immediately by Torres, although the responsible Bank may take between 15 to 20 working days to process the refund. It should be emphasized that refunds will only be made for unused Services, since once the service has been used, it will be considered as rendered and, therefore, no refunds will be made.
- Intellectual Property
The trademarks, logos, sample codes, computer programs and in general all the Content of the Torres Legal Services are protected by intellectual property rights. Access to the Site does not grant you any rights to these materials, nor any type of license. You may not use the content of our Site unless you request permission from the owner or as permitted by law. It is also forbidden to use Torres Legal’s trademarks and logos included in the Services without our consent, or to remove, obscure or alter the text or notices included in the Content that is published.
- Exclusion of warranties and liabilities
Usted acepta y reconoce que, al ingresar al Sitio y usar nuestros Servicios, y a pesar de los esfuerzos de Torres por evitar estas situaciones, podría quedar expuesto a materiales posiblemente ofensivos, indecentes o desagradables, publicados por otros usuarios; y, por lo mismo, acepta correr ese riesgo. Las opiniones expresadas en el Sitio o a través de nuestros Servicios no siempre reflejan nuestra forma de pensar colectiva en Torres Legal. Además, no apoyamos o respaldamos contenidos publicados por nuestros usuarios en cualquier foro de discusión o comentario.
Ni Torres ni sus proveedores y cesionarios garantizan que el sitio se mantendrá libre de errores o que el acceso al mismo sea siempre continuo y sin interrupciones. Entiende que descargará o conseguirá Contenido o Servicios a través del Sitio bajo su propio riesgo. Además, se previene que tanto el Sitio como terceras partes podrían sugerir enlaces a otros sitios electrónicos. Al no tener nosotros control alguno sobre otras páginas, usted reconoce y acepta que no nos hacemos responsables por la disponibilidad de los sitios externos y que tampoco respaldamos ni nos hacemos responsables por el contenido, publicidad, productos u otros materiales disponibles en dichas páginas. También reconoce y acepta que Torres no será responsable, ni directa ni indirectamente, de cualquier daño o pérdida provocada, o supuestamente provocada, por cualquier tipo de conexión con el uso o dependencia de su contenido, bienes o servicios disponibles en estos sitios electrónicos o a través de ellos.
- Limitation of liability
Neither Torres nor its suppliers, customers or assigns shall, in any event, by any provision of these Terms, under any contract, negligence, strict liability or any other legal or equitable theory, be liable for: (i) special, incidental or consequential damages; (ii) the cost of procurement or replacement of products or services; (iii) interruption of use or loss or misuse of data. Nor shall we be liable for any failure or delay caused by situations beyond our control.
- Changes
We reserve the right to modify or replace any part of these Terms. It is your responsibility as a user to periodically review them to identify changes; but Torres will also notify you directly, by any means of communication provided by you, of the modifications. Your browsing of the Site, following the publication of the changes, will imply your acceptance of the changes. In addition, Torres may include new services or features in the future, and such services or features will be subject to these same Terms.
- Several
The laws of El Salvador shall be the law of El Salvador in any dispute concerning these Terms, the policies, the Site or the Services. Any claim directly arising out of or relating to the Terms or the Services shall be litigated only in a court of competent jurisdiction in El Salvador, and both you and Torres hereby consent to the jurisdiction of such courts.
Any right of action or claim you may have relating to the Services must be made within one (1) year of the time of the claim or action or it will be removed from the file.
These Terms and Conditions, together with the Policies and other legal notices published by Torres, constitute the entire agreement between you and our platform with respect to the Services. If any provision is determined to be invalid, it shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
To the fullest extent permitted by law, you hereby release Torres and its officers, directors, employees, agents, affiliates and their respective successors and assigns from any damages or claims, known or unknown, suspected or unsuspected, disclosed or undisclosed, relating to any dispute relating to any transaction or attempted transaction with another user of the Services. You agree, understand and intend that this assumption of risk and release includes yourself and your estate, executors, agents, administrators and assigns.
