New Intellectual Property Law approved: key changes

The Legislative Assembly of El Salvador approved the new Intellectual Property Law on August 8th, 2024. This law aims to modernize the country’s regulatory framework to meet the demands of the digital era and globalization. The legislation was introduced to strengthen the protection of copyrights, trademarks, and other intellectual property rights, ensuring their relevance in an increasingly digitalized context.

The new law introduces significant improvements, including specific rules to address the challenges of the digital environment and optimized dispute resolution processes related to intellectual property. Additionally, it enhances the enforcement and supervision of infringements by establishing a more rigorous approach to prosecution. This is achieved through the creation of the new Salvadoran Institute of Intellectual Property, a division of the National Center of Registries, which has expanded powers. These powers include mediating conflicts, supervising collective management entities, and managing an information center on national and international works, among other functions.

These amendments strengthen the protection of local creators and entrepreneurs and aim to position El Salvador as an attractive destination for investment and innovation. The law fosters a more secure legal environment conducive to development in an interconnected world.
