El Salvador is preparing to take a significant step in digital transformation with the proposed Law for the Promotion of Artificial Intelligence and Technologies. This regulation aims to drive the development, research, and application of artificial intelligence (AI) across various strategic sectors, with the goal of improving the efficiency of natural resources, strengthening education, and boosting the country’s economic growth.
Artificial intelligence has proven to be a key tool for innovation, thanks to its ability to process large volumes of information, identify patterns, and optimize processes. With this law, the government seeks to promote investment in AI training programs, integrate AI learning into the educational system, and encourage its implementation in public services. In this way, technology is expected to improve the quality of life for the population and generate new economic opportunities.
The bill establishes that AI can be applied in sectors such as energy, health, security, and transportation, which would allow for the optimization of resource use and ensure equitable access to technological advancements.
One of the fundamental aspects of this legislation is the protection of personal data. The regulation includes security measures to guarantee information privacy and prevent its misuse. To achieve this, coordination with specialized cybersecurity agencies will be established, and existing data protection regulations will be enforced.
The law will apply to all natural and legal persons, both national and foreign, who engage in activities related to the development and implementation of artificial intelligence in the country. This will allow for free participation in the research and application of advanced technologies, provided that the established provisions are met.
To ensure the proper implementation of the law, the creation of the National Artificial Intelligence Agency (ANIA) is planned. This agency will be responsible for overseeing, regulating, and promoting AI development in the country. It will have functional autonomy and will work alongside government entities to ensure compliance with the regulations. Its main functions will include AI usage supervision, technical assistance, and public training. Additionally, the agency will manage the National Registry of AI Development, Innovation, and Application and support the incorporation of AI education into the educational system.
Another key aspect of the legislation is the recognition of intellectual property rights related to artificial intelligence. The regulation establishes that any patent, copyright, or trade secret derived from AI development in the country will belong exclusively to its creators. This will encourage innovation and provide legal security to those investing in AI research and applications.
With the implementation of this law, El Salvador seeks to position itself as a regional leader in artificial intelligence. Its application will not only facilitate economic growth and the modernization of public services but also optimize the management of natural resources and strengthen the educational system. If effectively developed, this regulation will mark a milestone in the country’s technological evolution and open new opportunities for sustainable development and innovation.
